Understanding the Duty of Principal Designer Under the CDM 2015 Regulations

The Construction (Design and Management) Regulations (CDM) 2015 set out crucial legal requirements for all parties involved in construction projects, from the design phase through to project completion. These regulations aim to manage health, safety, and welfare in various types of construction work, including new builds, refurbishments, demolitions, conversions, extensions, and maintenance. One key duty outlined in these regulations is that of the Principal Designer (PD), a position that plays a pivotal duty in ensuring safety and effective project management, particularly during the pre-construction phase.

Key Responsibilities of a Principal Designer

Under CDM 2015, the PD has specific key duties during the pre-construction phase to ensure safety:

Plan, Manage, Monitor, and Coordinate Health and Safety: Assess relevant information, like the health and safety file, to guide safe design work before and after construction begins.
Advise the Client: Help gather pre-construction information and ensure all designers and contractors have the details needed to carry out their duties safely.
Collaborate with Designers: Work with other designers to eliminate or reduce foreseeable health and safety risks.
Facilitate Communication and Cooperation: Ensure coordination and risk management among all parties during the pre-construction phase.
Liaise with the Principal Contractor (PC): Keep the PC informed of risks that need to be controlled during the construction phase.

PD Duty on Domestic Projects

For domestic clients, if no PD is appointed, the designer in charge of the pre-construction phase assumes the duty. If multiple contractors are involved, the PC usually takes on the client's responsibilities. The PD can also enter into a written agreement to take on the client's duties.

Tennyson Suite Steps into Principal Designer Role Under BSA

The tragic 2017 Grenfell Tower fire prompted significant changes in building safety regulations in the UK, leading to the amendment of the Building Safety Act (BSA) 1984 to the now BSA 2022. Following the incident, the government commissioned an independent review, led by Dame Judith Hackitt, which highlighted the need for a clear and reliable system of safety information known as the Golden Thread. This concept emphasises that safety information must be properly stored, accessible, and updated throughout the lifecycle of a building. For projects that involve more than one contractor, the BSA requires the client to appoint both a Principal Designer (PD) and a Principal Contractor (PC) to oversee different aspects of the project’s safety.

Principal Designer (PD) Responsibilities

The PD ensures building safety during the design phase by:

Planning & Coordination: Overseeing design work to comply with regulations.
Regulatory Compliance: Ensuring designers meet their legal duties.
Collaboration: Sharing information with the Principal Contractor (PC).
Communication: Communication and coordination between all parties.

For High-Risk Buildings (HRBs), the PD must establish:

MOR System: Manages safety incident reporting to the Building Safety Regulator (BSR).
Golden Thread: Stores and shares key safety information.
Competence: Verifies designers' qualifications.
Change Control Plan: Ensures regulatory compliance for all design changes while maintaining the Golden Thread of safety information throughout the design and construction phases.

SMSTS Course - Day 2 Completed

Health, Safety, and Welfare in the Construction Industry Discussed.

On Day 2 of the SMSTS Course, the delegates on the course discussed the pro-active approaches to ensuring the health, safety, and welfare of workers and managers on construction sites in the UK and across the planet.

Our starting point was the importance of providing essential welfare facilities on site to meet the minimum standard required under the CDM Regulations 2015.

We also discussed and undertook practical exercises in those hazards which, if not adequately controlled, result in long-term ill-health effects on workers on construction projects.

In particular, we focused on the low cost practical applications which can be adopted and employed to control the risks associated with noise, dust, vibration, asbestos and lead.

Day 1 of the SMSTS Course Underway

SMSTS Course - Day 1 Complete.

Tennyson Suite's Training Centre was the venue for the latest SMSTS Course to be held for its clients.

Amongst the delegates attending were projects and contracts managers and newly appointed site managers from Bishop and Levett and Project Managers from University Hospitals Sussex NHS Trust.

Using practical team workshops, the delegates have experienced hands-on risk assessment training, learnt about the primary and subordinate health and safety legislation, and taken away practical technological advancements to help them in the workplace, including applications such as 'what-3-words' to direct deliveries, operatives, and visitors directly to their site entrance gates / doors, vehicle parking locations, and also specific workplaces.

Over the next 5 weeks, the course will examine those construction activities undertaken on their projects which require proactive health and safety management to ensure a safe working environment on their sites.

Aims of the course.
The course aims to help delegates to plan, manage, monitor, and implement health, safety and environmental aspects on a construction project or site, in accordance with the latest legal provisions, in line with their duty in their respective management role.

Course duration and attendance.
Course days commence at 09.00 and conclude at 16.45.
Delegates shall be required to attend all 5 days at the Training Centre and pass an end of course written exam to gain the SMSTS Certificate.
The certificate lasts for 5 years in which time attendance to an SMSTS Refresher Course is required.

Course and workbooks are provided within the cost as is tea and coffee refreshments.

The cost per delegate is £650.00 + VAT, although discounts are available for bookings of six persons or more made by the same employer.

The dates set are:

Wednesday, 22nd March 2023 and Thursday, 23rd March 2023.

Who is this course for?
This two-day course is for delegates, (site managers, contracts managers, project managers, as well as those who manage personnel on construction sites), who have previously passed the full SMSTS Course, or subsequent SMSTS Refresher Course.

The delegate shall be required to bring with them a valid, in date, SMSTS or SMSTS-R Certificate. Please note that if the certificate’s expiry date has lapsed, then the delegate shall be required to attend the full five-day course.
Delegates must be competent in written and spoken English necessary for operating efficiently at site management, senior site management and project management level. The delegate shall benefit from group working with the other attendees.

This refresher course aims to help the delegates improve awareness of recent developments in construction, the latest legislation in health, safety, welfare, and environment.

This is a two-day course.

Exam Day 23rd March 2023.
Course days commence at 09.00 and conclude at 16.45.

Lee Wingrove has been promoted to Director of Health and Safety Services at Tennyson Suite Limited.

I hope that you will join me in congratulating Lee Wingrove, in his new position as Director of Health and Safety Services. Lee has worked tirelessly to develop himself and help grow the business over the past 5 years and will continue to shape the way for the health and safety team in the coming years ahead.

You may ask, where is John going? The answer is nowhere. John will retain a non-executive Director position and continue to work doing what he loves with the FCDO, the National Museum of the Royal Navy, Troia and our new client, the University of East London, in a consultancy capacity.
